It is generally accepted that the UK and the EU wanted to negotiate a free trade agreement. Dominic Raab, the British foreign minister and prime minister, said Britain would be better able to negotiate a free trade deal with the EU after a no-deal Brexit. [117] However, the government institute objected and indicated that, in this case, the negotiations would not be covered by Article 50, but by EU rules for `third countries`, which `are taking place on a different legal basis, with a more complex process and ratification requirements – which will probably involve ratification in the 27 parliaments of the Member States`. [118] [119] The British Parliament approved the draft agreement by adopting 2020 implementing laws (The European Union Withdrawal Agreement (Withdrawal Agreement) Act 2020. Following the signing of the agreement, the UK Government adopted and tabled the UK`s ratification instrument on 29 January 2020. [7] The agreement was ratified by the Council of the European Union on 30 January 2020, after approval by the European Parliament on 29 January 2020. The UK`s withdrawal from the EU came into force on 31 January 2020 at 11 .m GMT, when the withdrawal agreement came into force in accordance with Article 185. The British Parliament decides that a further extension of the Date of Brexit is necessary because it first wants to examine the corresponding laws before deciding on the withdrawal agreement. The UK government is then asking the EU to postpone the date of Brexit to 31 January 2020. Air transport would have been particularly affected if the common European air area and the EU-US “open skies” agreement no longer applied to the UK following a “no deal” Brexit, as World Trade Organisation rules did not cover the sector,[44] meaning that a British plane would not have been able to land at an EU airport the next day.
[45] In September 2018, the UK government said that in the event of a non-agreement on air transport, the UK would allow EU airlines to use BRITISH airports anyway and expected EU countries to retaliate. [46] There have been a number of other issues in the area of air transport, including EUROPEAN-wide air traffic control, service agreements with the EU and other countries, safety rules and the UK`s relationship with the European Aviation Safety Agency. [42]:7 EU-UK flights should not be affected for some time after a non-agreement exit, provided that the EU and the UK respect each other`s rights in this area.
